Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Brew web application and related services (collectively, the "Service") provided by [Company Name] ("we", "us"). By creating an account or using the Service you agree to be bound by these Terms and our Privacy Policy.

If you do not agree, do not use the Service. You must be at least 16 years old to create an account.

Brew lets you upload a photo of a latte art pour and receive AI-generated feedback on shape, symmetry, contrast, definition, and milk texture. The Service is provided on a reasonable-efforts basis. We do not guarantee that the AI analysis is accurate, complete, or suitable for professional use.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. Where reasonably possible we will give you 30 days' notice of material changes.

You are responsible for:

• keeping your login credentials confidential;
• all activity that occurs under your account;
• notifying us immediately via our contact form if you suspect unauthorised access.

You may not create an account on behalf of another person without their permission, or use automated means to create accounts.

You agree not to:

• upload content that is unlawful, obscene, or infringes any third-party rights;
• attempt to reverse-engineer, scrape, or extract data from the Service;
• use the Service to train competing AI models;
• circumvent usage limits, rate limits, or access controls (including sharing accounts to bypass the free tier);
• transmit malware or otherwise interfere with the Service's infrastructure.

We may suspend or terminate accounts that violate these rules without prior notice.

You retain full ownership of the photos you upload. By uploading a photo you grant us a limited, non-exclusive, royalty-free licence to store, process, and display the photo solely to provide the Service to you.

We will never use your photos to train AI models, sell them, or share them with third parties except as described in our Privacy Policy.

Brew's feedback is generated by an AI model and is provided for informational and educational purposes only. It may contain errors or omissions. We make no warranty that the feedback is accurate, and we are not liable for any decisions you make based on it.

All software, design, trademarks, and content in the Service (excluding your uploaded photos) are owned by or licensed to us. You may not copy, reproduce, or create derivative works without our prior written consent.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, accuracy, or uninterrupted availability.

To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data arising from your use of the Service.

Our total liability to you for any claim arising from these Terms or your use of the Service will not exceed the greater of (a) the amount you paid us in the 3 months preceding the claim or (b) €10.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable EU consumer law.

You may close your account at any time from your account settings. We may terminate or suspend your account if you breach these Terms, with or without notice depending on severity.

On termination: your access ends immediately, your photos are deleted within 30 days, and your pour history is deleted within 30 days unless we are legally required to retain records.

These Terms are governed by the laws of the European Union and the member state in which we are registered. Any dispute that cannot be resolved amicably shall be submitted to the competent courts of that member state.

If you are a consumer resident in another EU member state, you may also rely on the mandatory protective provisions of the law of your country of residence.

We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
